Food Hygiene: LEGISLATIVE REQUIREMENTS:

Regulation (EC) No 852/2004 Annex II Chapter VI places the responsibility for refuse control and management squarely on the Food Business Operator (FBO).
This responsibility covers the following aspects:
1. Ensuring refuse containers and stores are kept clean and are protected against access by pests.
2. That all refuse containers are fitted with close fitting lids to prevent access to flies and reduce unwanted smells.
3. That all refuse storage areas are kept thoroughly clean and that the surrounding area is also maintained in a clean and tidy condition.
4. That adequate provision is made for the disposal or collection of food and other refuse.

Environmental Health Officers and other aurthorised Environmental Health Practitioners are able to take staged enforcement action against Food Business Operators for non-compliance with the above legislation. This could be a formal letter with schedule, the service of a Hygiene Improvement Notice or even the instigation of legal proceedings in worst case scenarios. Any intervention of this type will invariably effect on the businesses overall Food Hygiene Rating score.
